RESIDENT MAGISTRATE'S COURT.
Wednesday, Mabch 18. (Before J. Curling, Esq., R.M., & J. A. Smith, Esq., J.P.) Lechner v. A T ias. The plaintiff sought to recover from defendant, the captain of the brigantine Dart, the sum of £19 Is. 6d. for commission on freight collected by him as agent for the vessel. Plaintiff stated that he induced Messrs. Sutton, Begg and Kinross to give freight to the Dart from Sydney. He had also engaged a cargo of wool, tallow, &c, for her return trip, and the defendant was with him whilst he made application to Mr. Kinross and others for freight, and that he had charged the usual commission, viz., 5 per cent. Mr. Kinross and Mr. Begg corroborated plaintiff's statement as regards the application to them for. freight, and as to the customary charge for commission on obtaining cargo for a vessel. Defendant denied that he had engaged plaintiff to, collect freight for his vessel, but had merely employed him as Custom House agent, to clear him in and out, and stated that he paid the plaintiff all he considered due him. Judgment for plaintiff for whole amount, and costs 15s. Feiday, Mabch 20. (Before H. B. Scaly, Esq., J.P.) John Smith and Thomas Smith were each, on the charge of Corporal Evans, fined ss. for drunkenness in the streets of Napier on the previous evening.
