Resident Magistrates' Coubt.— We have been requested by Messrs. Stuart, Kinross, & Co., to publish the following evidence in the case of Muim v. themselves, recently heard by the Bench, and a one-sided report of which they allege to have appeared in the Times: — W. Lechner, cashier to Messrs. Stuart, Kinross & Co., deposed: — That at time of giving receipt for passage money to D. Munn, he told him the steamer would not go unless a sufficient number of passengers offered, and that the passage money would be returned to him in the event of the steamer not sailing. To this D. Munn agreed. Murray Anderson, shipping clerk to Messrs. Stuart, Kinross & Co., deposed, that lie heard preceding witness, Mr. Lechner, state to D. Munn, that a passage could only be had on the above conditions, to which Munn did not appear to object. D. Munn, on cross-examination, admitted that at the time of taking his passage he was told that the steamer would not proceed to Wairoa if a sufficient number of passengers did not come forward.
