NOTICE. TXTE HEREBY GIVE NOTICE that by deed TV of assignment dated the Bth day of Oct., 1858, and made between Daniel Munn, formerly of Wellington, in the Province of Wellington, and Colony off- New Zealand, but then of Napier, in the District of Ahuriri, in the same Province, licensed victualler, of the first part, and James Meliss Stuart and John Gibson Kinross both of Wellington, aforesaid, merchants, of the second part, and the several other persons whose names and seals were thereunto subscribed and set, being several creditors of the said Daniel Munn, of the third part, — After reciting a certain deed dated the Bth day of October, 1858, and made between the said Daniel Munn of the one pariv and the said James Meliss Stuart and John Gibson Kinross of the other part, being a conveyance by the said Daniel Munn to the said James Meliss Stuart and John Gibson Kinross, their heirs, executors, administrators, and assigns, of all the real and leasehold estates of the said Daniel Munn, — IT WAS WITNESSED that for the -consideration in the said deed of assignment mentioned, the said Daniel Munn did thereby assign and set over unto the said James Meliss Stuart and John Gibson Kinross, their executors, administrators, and assigns, all' and every, the stock in trade, goods, wares, and merchandize, household furniture, plate, linen, china, books of account,, book and other debts, sum and sums of money, and all horses, cattle, sheep, carts, drays, whaleboats, and other boats, and all other the personal estates and effects whatsoever, of him, the said Daniel Munn, in possession, reversion, expectancy, or otherwise, except the wearing apparel of the said Daniel Munn, and of his wife and children, — UPON CERTAIN" TRUSTS in the said deed mentioned and amongst other trusts, UPON TRUST that if the said D. Munn should not, on the Ist day of October, 1859, pay the several debts in the said deed of assignment mentioned, and thereby secured, that then the said James Meliss Stuart, and John Gibson Kinross and the survivor of them, do and shall take possession of, call in, collect and receive all and singular the real and personal estates of the said Daniel Munn, and sell the same as in thesaid deed of assignment mentioned, — AND we hereby caution and warn all persons from dealing with the said Daniel Munn in respect of any of the said real and personal estates of the said Daniel Munn so conveyed and assigned to us. KN 0 W YE that Daniel Munn has paid off most of the liabilities that he assigned his property IN TRUST for, and that he, previous to the Ist day of October, arranged, through Messrs. Bethune and Hunter and W. M. Bannatyne Esq., merchants, of the City of Wellington, also gave his bills for the several amounts owing to his creditors, which does not become- due until the 15th day of January 1860, and that on or previous to that date he will be prepared to "square the yards with the world ; " and in conclusion, hereby informs Messrs. Stuart, Kinross, and Co. they had better "gang hame again and learn their grandmithers to sook eggs," before attempting to Jew the founder of the Province of Hawke's Bay, and of twenty years colonial experience in New Zealand.
