EXECUTIVE.

Session 1, IS T o. 1. AN ACT to repeal an Act of the Provincial Council of Wellington, Session 1, No. 1, intituled "An Act to establish an Executive Government for the Province of Wellington" and also the Act of the Provincial Council of Wellington, Session 6, No. 2, intituled "An Act to amend the Executive . Government Act, Session 1, No. 1, so as to authorise the Offices of Treasurer and Secretary to be held by one person" ; and also to establish an Executive Government for the Province of Hawke's Bay. 12 E IT ENACTED by the Superintendent of the Province of Hawke's Bay with the advice and consent of the Provincial Council thereof, as follows: —

1. The Act of the Provincial Council of the Province of Wellington, Session 1, No. 1, intituled "An Act to e.s,:tablish an Executive Government lot the Province of Wellington," and also the Act of the Provincial Council of Wellington, Session 6, No. 2, intituled "An Act to amend the Executive Government Act, Session 1, No. 1, so as to authorise the offices of Treasurer and Secretary to be held by one person," are, and each of them is hereby, wholly and entirely repealed. 2. The entire administration of the Provincial Executive Government shall be vested in the Superintendent alone acting by and with an Executive Council. 3. He shall keep and use officially the Public Seal of the Province. 4. The present Superintendent shall provide a Public Seal for the Province, with such device and inscription as he may think fit, and the same shall not be subject to change, except by an Act of the Provincial Legislature ; until such Seal shall be procured he may a:lopt and use such temporary Seal as he may think fit. 5. There may be a Solicitor for the Province, who would be the legal adviser of the Superintendent. 6. There shall be a Treasurer for the Province who shall receive and pay all monies payable for the uses and on behalf of the Province. 7. No public money shall be paid by the Treasurer unless the warrant for the payment thereof shall have been signed by the Superintendent and registered in his Office. 8. The Treasurer shall give Bond with a sufficient penalty, or other security, for the faithful discharge of his trust to, and to the satisfaction of the Superintendent. 9. The Treasurer shall not during his continuance in office engage in any business of trade or commerce, nor act as a Broker, nor as Agent or Factor, for any Merchant or Trader. 10. There shall be an Executive Council. 11. That the Superintendent shall appoint an Executive Council to consist of two persons, being Members of the Provincial Council, such Members to hold office during the pleasure of the i Superintendent. 12. The Superintendent shall from time to time by and with the consent of the Executive Council as aforesaid, j constitute all such Offices as he shall deem expedient for carrying on the bu- ; siness and affairs of the Province, and fill up the same and all existing Office's whenever a vacancy shall occur therein, with fit and proper persons. He shall also have full power to suspend and remove any Officer from his employment , for neglect of, or inattention to, his dv- j ty, or for other just or sufficient cause. 13. The Superintendent shall prescribe Rules for transacting the business of the several Offices of the Province, and from time to time alter the same as to him may seem meet. 14. If any person (not being a Member of the Executive Council,) shall deem himself aggrieved by his suspension or removal from Office, he may present a petition to the Executive Council, shewing that he has been suspended or removed from Office, without just or sufficient cause, and praying for an investigation into the ground or charge, on which he may have been suspended or removed. 15. This Act shall come into operation from and after the passing thereof, and the notification of the Governor's assent thereto.
