COURT REFUSES WRIT
RESERVED JUDGMENT GIVEN COMPANIES COMMISSION CASE NO JUDICIAL FUNCTIONS. (By Telegraph—Press Association.) WELLINGTON, May 1. The judgment of the Full Court in what is known as the ‘ ‘companies commission case” heard on April 18, 19 and 20, was delivered by the Chief Justice, Sir Michael Myers, this morning. Judgment was given for the defendant commissioners, the court holding the appointment of the commission to~be intra vires in that it had been appointed to inquire, both into the operation of existing.legislation relative to company masters and also into proposed legislation. The writ of prohibition asked for could not be granted, as the court was satisfied that the commission could exercise no indicia! functions and was not a judicial tribunal in any legal sense. That being so._ the questions' of bias or pecuniary* interest did not arise and the charges made in that respect by the plaintiffs were not considered bv the court. Costs amounting to 35 guineas were allowed to the defendants.
