PEDESTRIANS’ RIGHTS

Pedestrians in the United States have at all times the right of way over motor vehicles, and traffic authorities have warned motorists as to their liability in accidents in which pedestrians are involved.

The warning was prompted by a recent decision of the courts, fwhicii have produced many points in favour of pedestrians, who now have the right to use all parts of the highways, and are chargeable for . a reasonable amount of care only. Pedestrians injured in the centre of the street are not considered as negligent because they are there instead of on the side walk.

If a pedestrian is hit by a car coming from behind him, he is not negligent, as he is not bound to be looking and listening for approaching motors. The rule of reasonable precaution reuuires a motorist to be: certain that the pedestrian is aware of bis approach at a reasonable distance to avoid running him down.
