CLAIM FOR DAMAGES
SEQUEL TO COLLISION. PLAINTIFF’S CASE FAILS. Claiming £25 general damages and £2 17s 6d special damages for medical expenses, P. H. Trim proceeded against G. R. Horsburgh in the Hawera Magistrate’s Court yesterday, the action bell ing a sequel to a collision between a bicycle ridden by plaintiff and a motor van owned by defendant and driven by J. H. Thoms, an employee. I Mr L. A. Tavlor represented plaintiff and Mr G. .L Bayley appeared for defendant.. Plaintiff stated that, ho had been riding his cycle along High Street towards town on June 23 and was on his correct, side of tho road, when defendant’s van, driven by Thoms, had been swung out suddenly from the footpath, \gainst which it had been parked, and had caused him to collide with it. As the result of the impact he had been injured and had had to reecive medical attention, besides being off work. Lengthy evidence was given by both 'parties, the defence being a denial that the collision was caused by the van, which, it was claimed, had been stationary when plaintiff had ran into it. The Magistrate (Mr J. H. Salmon, S.M.) gave judgment for defendant, with £3 Gs costs.
