HIGHWAY RIGHTS

STRAY DOGS AND STOCK

In a suburban court recently a magistrate decided that a dog lias no right to be on the highway unless it Is in charge of some person. A claim by the owner of a dog for damages from a motorist whose car killed it was dismissed.

Some legal advisers disagree with the opinion expressed by the magistrate They say that in common law a dog or any other animal lias as much right to the road as the motorist, and that the motorist has the responsibility of exercising every reasonable care. The provisions of the Local Government Act relating to straying stock do not establish negligence on the part of the owner in civil actions. Even if a horse is wandering unattended on -any road a motorist must not keep on driving at a fast speed or acting in any other way that is likely to result in the injury or death of the animal. in every (circumstance a motorist is required to be reasonably careful.
