SUPREME COURT.

VARIATION OF WILLS. At the New Plymouth Supreme Court- yesterday, before the Chief Justice. (Hon. M. Myers), Ellen Adlam, wife of Stephen Adlam, of Alton, applied that the will of her late father, Paul Willcox, of Opunake, farmer, be varied to increase the allowance made to her.

Mr P. O’Dea, who appeared in support, said that unfortunately for the present application a considerable legacy had recently been left to applicant’s husband. In face, of this all lie would ask for was that the legacy under the will should he paid at once, and that her costs should he paid out of the estate.

Mr It. H. Quilliam, who appeared for the widow, asked that the widow’s allowance should be increased. The widow, testator’s second 1 wife, resided in England. His Honour said l that before lie would make an order he must know the exact position of the property in England, and the case was .adjourned to enable this to he done.

Mr C. H. Weston appeared for the Public Trustee, the. executor of the will so far as the New Zealand estate was concerned.

DAUGHTER’S APPLICATION,

A similar action under the Family Protection Act was brought by Violet Palmer, May O’HaUoran and Florence Carter against the Public Trustee and Leonard Walker and Twentyman Walker, the principal beneficiaries under the will of their mother, Annie Walker, late of Stratford. The applicants were daughters of the. testator, and claimed 1 to be in poor circumstances. The bulk of the estate had been left to. their* two brothers.

Mr P. O’Dea, who appeared for the two brothers, claimed that these two brothers had always stood by their parents, and that the present position of the estate, winch was worth about £6OOO, was due to their efforts. For the applicants Messrs C. H. Weston and L. M. Moss appeared, while the executor (the Public Trustee) was represented by Mr O. H.Choker.

His Honour allowed Mrs Palmer 25s a week, Mrs O’Halloran 20s a week, and Mrs Carter a. lump sum of £2OO, costs of all parties to be paid out of the estate. IN DIVORCE. On the motion of Mr O’Dea, a. decree absolute was made in divorce, together with custody of -idle child, to Annie Louisa Panckhurst in her action against Walter Henry Panckhurst.
