FARM LEASE.

LEADS TO C OURT ACTION. NEGLECT ALLEGED. The hearing was oommenced before Air. J. H. Salmon, S.M., at the Hawera Alagistrate’s Court this morning of a case wherein Daniel Jarvis Willis 'and Hallet Thomasine Willir, both of Great ford, farmer and married woman respectively, proceeded against Edward Norman,' of Hawera, farmer, claiming damages for alleged breaches of covenants of a lease: Air. J. Houston appeared for plaintiffs and Air. P. O’Dea for defendant. The statement of claim set out that in August, 1926, plaintiffs leased to defendant certain lauds at Ararata with buildings thereon, the lease containing an express covenant on the part of defendant to keep in good order and condition and repair all buildings, fences, gates, stock yards, etc., at the commencement of the lease or at any time during the lease, and to renew I such parts thereof that had become <le-1 cayed or unserviceable. Defendant, it I was alleged, had failed to repair and keep in good order the fences, gateways and trough approaches, and for tliis alleged breach of covenant plaintiffs sought to recover £7O Is -Id by way of damages. It was further alleged that defendant had failed to keep down ragwort and gorse, neglected the pastures, failed to sow down an area of 16 acres in a proper manner, I failed to keep the buildings in repair, failed to pay his proportion of the rates due to the Hawera [County Council and Patea Harbour Board, and failed to pay his proportion of the insurance premiums on the buildings; wherefore plaintiffs claimed the further sums of £l, £l6 10s, £lOl, £l3 -Is sd, £1 6s 6d. Alternatively, plaintiffs said that on subsequently selling the property to Charles and Garfield Ogle, they suffered damage by reason of defendant’s breach of covenant to the extent of £193 2s 3d, which sum they sought to recover. !
