An ex-parte application ivas heard to-day in the High Court, Western Samoa, on behalf of Olaf Frederick Nelson, formerly a Legislative Councillor for Samoa, for leave to serve a summons and statement of claim out of Samoa and in New Zealand upon General Sir George Richardson, a former Administrator. The cause of the action alleges that Nelson’s' deportation was ultra vires and invalid. Judge McCarthy refused the order on the grounds that there was concurrent jurisdiction in New Zealand, and, as both parties were there, bringing the case in Samoa involved avoidable expense.
