CLAIM FOR MONEY.
ACTION- AGAINST DAIRY COMPANY. CASE IN APPEAL COURT. [BY TELEGItAPH—PIIEBS ASSOCIATION.] WELLINGTON, March 16. The Appeal Court, to-day, heard the case Kerr v. Avo.ll Dairy Coy, Ltd., in liquidation, ,an appeal from the judgment of Mr. Justice Alpers in a test case. Kerr claimed from the company £25 6s lOd ,amount of balance due to ihim oil blitter fat, sold to the company, or alternatively, balance of the total price due to him for butter-fat, sold in London by the company as his agent. The amounts claimed by various suppliers aggregated about £3OO. The company had gone into liquidation and decided not to pay any bonus. Appellant had claimed that he was entitled to a bonus equal to the best paid by other companies in the district, but was nonsuited, although the Judge held that the suppliers were tricked by advertisements into sending their butterfat to the company. Argument is proceeding.
