NEW YORK, July 7
A message from Dayton, Tennessee, states that the 2di>J population of this rural town is expected to be augmented five-told temporarily during the trial, beginning on July 10, or John Scopes, a young teacher oi biology, w'fio will be charged that lie taught the •Darwinian theory of evolution in violation oil a recent Tennessee statute forbidding instruction on matters contrary to the letter of the Bible on the subject- of creation. Scopes voluntarily .submitted himself to arrest for the purpose of testing the validity of the statute, which lie alleges violates the Fourteenth Amendment of the Constitution, forbidding the abridgment of the privileges and immuiuitie.s, or the deprivation of the liberty of or property of a citizen of the United States by individual States. An imposing array of counsel, including Mr. Clarence Darrow, of Chicago, who defended Leopold and Loeb, and Mr. W;vi abridge, Secret ary of State in President Wilson’s Cabinet, contend that it is impossible for Scopes to exclude evolution in the teaching of biology, and the _ prohibition of such imperils his livelihood. A number of eminent scientists are expected to testify to tho truth of the theory.
The prosecution is headed by William Jennings Bryan, .in conjunction with prominent churchmen, who are working for legislation against the theory in all States.
