Public Service Assn. Secures Injunction Against High Official
ON A TECHNICALITY | WELLINGTON, Oct 9. Because of a technical legal oversight, the general manager of the State Advances Corporation, (Frederick Witham Eric Mitchell is holding his appointment invalidly. This was admitted in the Supreme Court today by the Solicitor-general, Mr H. E. Evans K.C., and an injunction was accordingly issued by Mr Justice Gresso’n resUi tuning Michell i;om holding tne appointment. It was pointed out by Mr Evans that validating legislation would be passed immediately and this, he said would make the injunction ineffective for more than a few days. Mr Evans said the defendant (Mitchell) was not objecting to the injunction being granted. Mr A. J. Mazengarb said the plaintiff, the Public Service Association, was concerned only to see that appointments to the Public Service were made in accordance with the legislation. Mr Mazengarb said it had been agreed with the Government that future appointments would be subject to control.by the Public Service commission and not by the board ol management of the State Advances Corporation.
