Pfahlert and Fred Havill, junr, the pipes being the property of Jas. A. Murdoch, and defendants having been proved, in the Court’s opinion, to have taken them from a claim. Jas A. Murdoch stated he -owned the claim at Kanicri Forke known as Robert’s, on which was a line of 13-inch pipes, bought from the Public Trustee, and which tfic witness recently found broken, with three pipes missing. Havill must have known that witness was the owner, because he worked the claim for a while, but left it without paying the rent. Pfahlert also knew witness was the owner.
