Mr Mosley, S.M., gave a written judgment in the case Sigley v. Stephens, heard on April 3, a claim for £3, in which the issue was whether the trainer can pledge an owner’s credit for stabling a horse, and the trainer’s keep. # The Magistrate said it was clear from the evidence that a contract was made by Kingam, Stephen’s trainer, and plaintiff looked to Kingam to pay. At the time the contract was made, plaintiff seems to have failed to hate made any enquiries its to the ownership of the horse, and had been quite satisfied to look to Kingam for payment. The only grounds upon which action can be sustained against Step hens is that Kingam acted as his agent or steward, and had au expressed or implied authority to pledge his princi pal’s credit. It was clear from the ev idence that Kingam had no expres" authority.

Ae regards an implied authority, the Magistrate said he was entirely unable to assume it must be taken as common knowledge that trainers have authority tn pledge owners’ credit for loose box es and board, nor was he aware that such a custom existed from which rn implied authority might bo doducod.
