A SEAMAN’S CLAIM.
BLA( KUALL COAL COMPANY SLED. M ELLINGTON, Marco 31. A claim lor a weekly payment of L’2 6s Id., as from August 25, 1921, to the date of the hearing, and for a. leasmiable lump sum in the way ot future weekly payments, was made m the Arbitration Court by Henry Hyde el Wellington, against the Black oall Coal Company, Limited. Plaintili alleged that on August 15, 1921, while he was employed on the defendant company’s steamsnrp ix’gahere, then in port at Timaru. he sullercd heart strain through *up a, hatch which was fulling into the hold. He did not realise at the rime, that Im was seriously injured, and continued his employment, but on August 25, 1921, be was unable to continue at his work. He had been totally disabled from that date. The company had made payments to him under the Shipping ami Seamen Act hut Ids condition entitled him to further compensation. The defendant company admitted that on August 15, 1921. plaintiff was in its employ; but it denied that any accident occurred to him while he was m such employ. Mr A Regain produced as a. witness the man who was said to have thrown the hatch-cover which plaintili' endeavoured to prevent from falling. Witness was asked whether plaintili showed that In 1 was hurt. ‘AVell, he called mo a. very nasty name," was the reply. Counsel did not trouble to ascertain more particularly what the plaintili' said. The case was adjourned.
