UT-LA^S OF THE GREY COUNTY COUNCIL, 1914. TN Pursuance and in exercise of t}ie powers, provisions, and authorities contained, in ' 'The Counties Act, 1908 •;' ' "The Public ' Work's, Act 1908;" and "The Motor Regulation- Act, 1908;" "The West! and, Grey, Jnangahua anrl Buller Counties Vehicle Licensing Act. 1832;" and any amendment thereof respectively, and all other enabling powers, provisions and authorities contained in any other Acts, ot otherwise vested in it, the Council of the Grey County hereby makes by this Special Order the following By-laws'- — PART I. INTRODUCTORY. REPEAL. 1. By-laws Nos. 2 to 19 heretofore made by the Grey County Council are hereby .repealed. 'DIVISION OF BY-LAWS. 9. .These by-laws are divided into eleAen parts, numbered 1' to 11 inclusive, each of which parts is divided into sections. The schedules appended to these by-laws shall be deemed to form part theieof., and a slight deviation from the forms prescribed, but to the same effect and not calculated t^ mis* lead, shall not vitiate them. INTERPRETATION. 3. In theso by-laws if not inconsist. ent with or repugnant to the context "Billiard Room" means and includes every room to which the public are admitted, and which is or mtiy bo used for the purpose of playing billiards, pool, pyramids, bagatelle, or other games oi a like nature for payment, but does not include a billiard room in any pre : mises licensed under "The Licensing! Act, 1908," or a clnb. "Bridge" and "Culvert" means any bridge or culvert respectively under the care, control, or management of the Grey County Council, or a-ny bridge or culvert within the Grey 1 County as to which the said Grey County Council has by law, authority to make this by-law, or as to which the sameis capable of operating. "Bicycle shall include tricycle, velocipede, and every or any other similar machine not ' propelled :by motor power. "Cattle" includes any colt, filly,foal, gelding, horse or mare; any bull, calf, cow, heifer, ox or steer j any ewe, j lamb, ram, or wether ; any ass, mule or goat; and any hoar, sow of other pig Vide Section 2of the Public Works Act, 1908. "Council" means tho Grey County Council. : A "'County" moans th« Grey County. 1 'Disc ' moans a metal disc painter! red on one side and white on *he other, at least 18m. m diameter and fixed 'by authority of the Council in a conspicuous position above tbe level and on the side of the road. "Gross weight" means the weight of a vehicle, -traction eng/ne, motorwaggon, or .machine, together with any thing or things being transported thereon. "Jinker" means : — (1.) Any vehicle or vehicles used for the purpose of carrying timber, iron, machinery* or other materials by being suspended from and under the axle or axles of such vehicle or vehic les. / (2 ) Any vehicle or vehicles carrying in any way whatsoever timber, iron, machinery or other materials of an;y greater length than 20 feet, and not heing included in tho previous paragraph. "Heavy Traffic" in this by-law means the transportation of any /vehicle, en* e;i.ne, or machine which shall itself, or together with any thing or things be ing tram-ported thereon, weigh more / <han one and a half tonu avoirdupois Lo each pair of wheels. In calculating for the purposes of this bylaw the weight of a vehicle unladen, the weight of any wator, -fuel, or accumulators used for the-- purposes of propulsion shall not be -included. Vide tiection 2 of "The Motor Regulation Act, 1908"— "ivlotor" shall include Motor Car, Motor "Waggon, and Motor Cycle. • 'Motor Car" means any motor having not less than three wheels and usea solely for , -carrying passengers and their personal luggagfe. "Motor Waggon" means any motor ".arrying ov constructed -to carry load-, ing surh as in enumerated on Schedule A. hereof. ' -,'•', "Offence" means an offence 'against any of the provisions „. of 'this by-law, md includes the omission or neglect to comply with any 'part thereof. "Owner" includes a baillee entitled to tho possession aiid'iise of a* motor, bicycle, traction engine, or vehicle. "Person" includes any incorporated body or company. ' "Road," in addition to the- meaning assigned to it by the above named Acts or any of them; means send includes any highway, road, street, thoroughfare, or way of a public nature,- or used by the public as of right, and under the care, control, or management of the Grey County Council, and unless repugnant to the context, includes any bridge, culvert-, ford, or other' thing appei'taining to *a road. "Traction Engine" means any locomotivo engine propelled by sfeam or other mechanical power and designed for use on ordinary roads. "Vehicle" means and includes every buggy, cab, carriage, cart, coach, drag, dray, express, gig, jinker, lorrj r ,' sulky, timber- waggon, van, waggon, and any other conveyance on wheels designed for use on ordinary roads ; and whether drawn by animals, or drawn or pro- • pelled by mechanical power. "Wheel Traffic" means traffic carried on by, or by means of any vehicle. Worlds importing the singular number include the plural number and vice versa, and words importing the masculine gender include females. PENALTIES. 4. Every person who shall do or cause" to be done, or be knowingly concerned m doing, or suffer to be done, an}'thing contrary to, or otherwise than as provided by these" by-laws, or who shall omit to do anything hereinafter required to bo donu by him, shall be .deemed guilty of an offence, and shall for each such^ offenfee (unless otherwise provided hereinafter) be liable to a. penalty ct five pounds (£5), or such lesser sum as the Court inflicting the same shall in its discretion think fit; £'.nd in every case in which such offence *ihall be ii conCi'iiuing one, then to a* penalty of £5, ur such" lesser sum as the Court shall think fit, for every day or part of a day during which such offente shall continue.
