WOLFE'S SCHNAPP IMPORTANT JUDGMENT. INJUNCTION GRANTED BY THE SUPREME COURT. (FROM THE ARGUS, IST JUNE, 1886.) "The plaintiff, Mr Joel B. Wolfe, claimed to be entitled to the exclusive use as a trade-mark of the names Aromatic Schiedam Schnapps, which he .had applied to a kind of gin sold by him in this colony and other places. The defendant, Mr D. G. E. Alsop, is the agent in Melbourne for Mr D. H. Burke, who also sells Schiedam Schnapps. Mr Burke had formerly been in partnership with the plaintiff, but the partnership was dissolved in 1882. The plaintiff sold his schnapps under the name of Wolfe's Aromatic Schiedam j Schnapps. The defendant, after the dissolution of the partnership, sold liquor under the name oiLßurke's Schiedam Schnapps. Theplainnff complained that this was an infringement of his trademark, which had/been registered in this , colony for more/S^an five years, Hia Honor held thati.the plaintiff had not an i exclusive use to c> the words he claimed as a trade-mark, but- he wss o£ opinion that Mr Burke had adopted the name ' Schiedam Schnapps' for the liquor sold by him, with the intention of inducing purchasers to believe that Me liquor sold by him was the plaintiff's gm ; that a reference to Udolpho Wolfe on the labels of Burkes wrappers was calculated to assist the deception by suggesting that Burke had either the right or the exclusive right to sell the s&me gin wheih he had sold when in partnership with Udolpho Wolfe and • his successors ; and that the liquor sold by him in bottles, labelled 'Burkes Schiedam Schnapps' was the same as that which the plaintiff wa3 selling in bottles labelled ' Wolfe's Aromatic Schiedam Schnapps.' He therefore made a decree in favor of the plaintiff (the proprietor of Wolfe's Schnapps) with costs, directing the defendant's firm to be restrained f om selling liquor in bottles with the labels referred to, and from doing any act which would induce to the belief that the gin manufactured by or for Mr Burke was the liquor sold by the plaintiff in bottles labelled .' Wolfe's Aromatic Schiedam Schnapps.|." Messrs M. Moss and Co. inform us fliat they estimate the costs ? in the suit, which has extended over three years, at above £2000. Medical.
