The Chief Justice in resuming his charge to the jury this morning, observed that it was much to be regretted that Mr Henry Young was not produced in order to see if he coiild identify the suit the defendant obtained, from him, and which has been so ! often referred to. Mr Hawkins— The prosecution, my Lord, communicated with Mr Yotjng and find that he possessed so large and varied a Stock, that he was unable after so long & period had elapsed, to swear to theiridentification. :, Dr. Keneally— lf Mr, Young could not identify, tin clothes, he would, perhaps, be able to remember my obese client. The Chief Justice— He might not, at that time, have been of such goodly proportions ? .... Mr M'Mahon— No doubt, my Lord, ' Mr Ygfng would willingly have come on the same terms as the other witnesses. The Chief J,usticer=rMr Young, I consider, proved himself a highly conscientious witness in declining to. receive the public f unds; knowing his evidence would not avail.;! believe he resides in New Zealand.
