WARDEN'S COURT, AHAURA.
Thursday, February 15. (Before Warden Whitefoord.) Hopley and party v. Borgeson and party. — This was a complaint that the defendants « ille^aiy^pnved 'ffie^ complainants : of water - for mining purposes at Half-Ounce. The' complainants are the Colreayy-Gpld Mining Company, working below Mabille's claim af Haft- 1 * Ounce. In consequence of the defendants deepening their tail-race, the complainants were unable to get sufficient head-water at a high enough elevation to drive their machinery. The certificate! of permission to deepen the tail-race of defendants, with plans ,of the ground, were put in... iTMp Warden said the certificate of defendants] was granted them after due inquiry, and^ in the usual course. The Court must' ; presume certificates obtained jn. thia ; manner were legitimate^ until good reasons were shown for setting them asideV' At the same time the Court wished to give prcspectorß every facility,;and if the ; complainants could get water elsewhere, without interfering with the defendants, an order would be made to enable them to do so legally. Judgment for defendants "with costs. ; : Samuel Loftquist applied for an agricultural lease of 20 acres at Napoleon.' The r application was opposed by a number iof 'the inhabitants, on the grounds that- the ' land applied for was. ljkely auriferous, and that now it was ther only commonage the -■ residents . of •= had.
