ASHBURTON COUNTY COUNCIL.

The usual monthly meeting of the above was held, at the Council Chambers yesterday. Present—Messrs W. C. Walker (chairman), T. Bullock, J. Jackson, A. McFarlane, J. Lambie, T. Taylor, E. G. "Wright, and H. T. Winter. The engineer's report was read and dealt with.

8 [}With| reference Jto branch race through Springfield to Mr Reynolds' property, it was resolved that Mr Reynolds be requested to proceed at once with the work of letting the water through his property so that the water might be available for further extension down the plains, or the Council would do the work at Mr Reynolds' expense.

In his report, the engineer suggested that the owners of property along the Wakanui Plat race should be asked to take the races inside their fences along the whole line |of the race, The suggestion was approved by the Council. Mr Taylor presented a petition re the Westerfield j water supply, and it was resolved that the matter be referred to the engineer to report, with a view to the work being undertaken at the earliest possible date, and that a committee, consisting of the chairman and Messrs Wright and Bullock, wait on the Hon. J. McLean with reference to the race being taken through his property. It was resolved that the engineer's suggestion, that water at the head works of the Mount Somer3 and Buccleucb race be turned on and allowed to run down as far as the Mount Somers township, be approved.

The water supply committee's report was read and approved, and it was resolved that no further engagements for additional water races bo entcredjinto at present, unless the committee are thoroughly satisfied there will be sufficient water to feed the race.

Mr Taylor presented a petition, asking that the water now flowing on to Dawson's road be diverted for the purpose of irrigating land belonging to those signing the petition. A petition -was also read from Mr Dawson and others, asking that the water be not diverted.

The matter was referred to the engineer to report. Mr McLean, chairman of the Upper Ashburton Road Board, waited on the Council with reference to an abatement of the small birds nuisance. The Council decided that the various Road Boards be written to, asking their co-operation in abating the nuisance under the provisions of the Act, and that a committee, consisting of Messrs Taylor, Winter, and Lambia, be appointed to collect information as to the be3t means of destroying the small birds. It was further resolved, on the motion of Mr Bullock, seconded by Mr Wright, that the sum of lOd be given for every 100 eggs or heads of small birds delivered at the Road Board offices, and that the various Boards be requested to make the necessary payments ion account of the Council. In accordance with a notice of motion given by Mr Jackson at the former meeting, it was resolved that application be made to the Government to constitute the entire county one licensing district under the Licensing Act Amendment Act, ISB2. A deputation consisting of Messrs Wason, McMillan, Coward, Herring, T. T. Jackson, Mackay and Allington, waited on the Council re the proposed rate to be levied to raise the sum of .£2611 10s 5d for the Rakaia and Ashburton Forks Railway Company. Messrs T. T. Jackson, Herring and Wason addressed the Council, and protested against the proposed action of the Council to collect a year's arrears of rates due by the settlers within the rating district of the Rakaia and . Ashburton Forks railway. Mr Jackson stated that from the first the settlers had been most unfairly treated by the Railway Company, and every proposal the settlers had made had been treated with scorn by the company. An injustice had been displayed in the classification of the land to be rated, causing much dissatisfaction to be felt, and the people of Rakaia had been persuaded to vote for the line though they were not in the district. Mr J. C. Wason said he felt Fgrieved at remarks that had been made of late to the effect that some of the ratepayers of the county were endeavoring to evade a liability they themselves had incurred, and he wished to convince the Council that such an imputation was utterly groundless, and that those who were protesting against the railway company's action had both law and equity on their side. It was well known that the land on either side of the river, and towards the hills was of much better quality than the backbone ridge through which the railway ran r but they had classified the land on the average system, so that unimproved land was of the same, importance for rating purposes as improved Land. When the directors throw down the gauntlet the settlers were prepared to try their rights in the Supreme Court, but they strongly objected to be handicapped by having to contest an action against the County Council of Ashburton. From the beginning that body had had nothing to do with the affair, and he urged that they would still refrain from taking any action in the matter of levying the rate.

Mr Herring also addressed the Council on the question, and protested against the rate being levied as proposed.

The Chairman said after what had been stated by the deputation the Council would take the matter fully into consideration, as 'had been done in the case of the deputation that waited on the Council at last meeting. After the deputation had retired, the Council went into committee, and on resuming, Mr Lambie said, after what had fallen from the deputation, he thought it would would be undesirable for the Council to interfere in the matter of raising the rate, and he would ask leave to withdraw the following notice of motion given at the last meeting : —" That the Council will at its' next meeting authorise the striking of a rate to raise the sum of .£2611 10s 5d for the Eakaia Eailway Company, as directed by the Minister of Public Works, in a letter dated 18th October, 1881." The report of the committee appointed to inspect the Eangitata ferry was read. The committee reported that considering the dangerous nature of the river it was absolutely necessary that the ferry service i should be continued. The report was adopted, and that Mr Jackson be offered the post of ferryman at .£4O per annum, and that the reserve on the island be let; a copy of the committee's report to be forwarded to the Geraldine County Council.

A letter was read from the South Eakaia Eoad Board, asking the Council to send their engineer to report on the proposed storm water scheme for the South Eakaia and Mount Hutt districts.

Resolved—" That the engineer be instructed to report on the storm water Scheme, and confer with the Eoad Board as to their views."

In reply to a communication from Mr A. E. Peache, chairman of the Mount Somers railway extension committee, it was resolved, on the motion of Mr A. McParlane, seconded by Mr Bullock—" That the Council accept the invitation to accompany the Minister of Public Works on a visit of inspection over the proposed route for the extension of the Mount Somers railway, and that Messrs Jackson, Lambie, and McParlane, be appointed to investigate the question of diverting the railway across the south branch of the Ashburton river, and to report at next meeting." Messrs Bullock and "Wright were appointed delegates to attend the meeting of the West Coast Eailway League to be held in Christehurch.

It was resolved to grant the sum of £o to the Hospital library.' In reply to an application from the Methven library committee for a grant-in-aid, it was resolved that the Council were not in a position to accede to the request. The area to bo rated in respect of Dobbins' ford bridge was agreed upon, and it was resolved that plans and an estimate of the cost of the proposed combined road and railway bridge over the Eakaia at Dobbins' ford be forwarded to the Minister of Public Works, with an application for

the amount requisite for constructing the said bridge. It wa3 further resolved that the Selwyn County Council be asked if they will take steps, under the Roads and Bridges Con- ! struction Act, to secure payment of a fourth of the cost of the proposed bridge I at Dobbins' ford, estimated to cost .£30,540 ; also, that they be asked if they will contribute in equal proportion with the Ashburton County Council. A number of accounts were passed, and after transacting some further business of a miscellaneous character, the Council adjourned.
