Ell, stockdealer, of Bingsland, deposed that on the night of June 16th, being in the Golden Fleece Hotel, he there saw the prisoner. The following evidence was taken: —John Wilson, a grocer and a Quaker, of Oxford terrace East, stated on his affirmation that at about half-past ten o’clock on the night of Wednesday, he was standing conversing with a man at the corner of Peterborough and Colombo streets. The conversation became a quarrel, and' witness took off his coat to fight. The fight, however, did not come off. At that time, witness believed, he had in his vest pocket a silver lever- watch with gold guard, which he valued at about £6. The watch and the fragments of the chain produced were the same. He had not seen the articles immediately before the altercation, but he always carried them, and now had’ no doubt they were then on his person. On'the morning of the 17th he found a broken portion of the chain attached to his vest j the other part and the watch was gone. At the time of the quarrel there were several persons standing round, but witness did not remember seeing the prisoner. Peter Brown, a fishmonger, stated that on Thursday night last he saw at the White Hart, the prisoner, who handed him the watch produced to sell for him. Witness then saw the piece of gold chain now produced in prisoner’s hand. Witness sold the watch for 10s to Mr Herman. Isaac Herman, jeweller, of High street, corroborated previous witness as to the sale of the watch. Thomas Heil, a detective officer, deposed to being at the corner of Peterborough and Colombo streets about midnight on the 15th inst. He saw prosecutor, who complained of a man named Hudson, who he said had struck him. Prisoner was with prosecutor when the latter spoke to witness. This was the whole of the evidence produced. Prisoner, who was undefended, had nothing to say, and was committed to take his trial on both charges at the next session of the Supreme Court to be held at Christchurch
