ASHBURTON, Thubsday, Januaet 15. [Before his Honor Judge Ward.]
Peter v. Fergus—Mr Gresson for plaintiff. Mr Parnell for defendant. Judgment by consent for amount paid into Court, £39 11s. Defendant’s costs allowed.
Peters v. Fergus—Claim £llß 18s 9d for use and occupation of land as per agreement. Mr Gresson for plaintiff, and Mr Purnell for defendant. After the conclusion of plaintiff’s case, Mr Purnell opened the defence and pointed out that the plaintiff had waived his claim to the rent. Mr Gresson objected on the ground that this defence was not included in the plea filed. His Honor upheld the objection, Mr Purnell then asked leave to amend his plea, and this was done. After healing further evidence, his Honor gave judgment for plaintiff for the amount claimed and costs.
Pauling v McKie.—Claim £67 10s, balance of commission on sale of land. Mr Purnell for plaintiff, and Mr Thomas for defendant. After hearing voluminous evidence, his Honor gave judgment for defendant with costs. Tisch v Carter.—Claim £SO, for trespass on land. Mr Purnell for plaintiff, Mr O’Reilly for defendant. After hearing evidence, judgment was given by consent for one farthing and costs, defendant to carry out purchase by paying £45 at once.
BANKEUPXCY OASES. Re Timothy Murphy, Daniel Lynch, and others.—Application for discharge. Mr Purnell in support of application. Granted. Be George Kelly.—Application for discharge by Mr Purnell. Granted. Re Richard Morgan.—Application for discharge made by Mr Purnell. Granted. Re James McKenzie.—Application by Mr Purnell for an order for payment of costs was granted. Re Reuben Kite. —Application for appointment of trustee in place of George Allen resigned. Mr O’Reilly appeared in support, and Mr F. Pavitt was appointed. Re Thomas Dudson.—Mr O'Reilly applied for an order for payment of coats, Mr Purnell opposed. Application adjourned till next sitting of court. Mr O’Reilly applied on behalf of same bankrupt for order to inspect trustee’s books. Application refused. Ro James Daly.—Application for moneys belonging to estate held by Bank of New Zealand. Mr O’Reilly supported application. Mr J. E. Hyde Harris opposed. His Honor said if demand was made for money in question and it was not paid, Court would make an order for payment of same next Court day. The Court then adjourned.
