A writ directing the Tima.ru Borough returning officer to return a deposit of £lO he had lodged with his nomination for tho Timaru Mayoralty, and from which ho voluntarily withdrew a dia-y - later than the specified seven cleair days, was sought by Oha-rlas Eust ace Kerr in the Supreme Court at- Timaru yesterday. Mr Justice Northcroft made- an -order for the return of t-lie deposit. Tie said lie wa-s unable to accept the view of the Audit Department that the deposit' was not returnable because of the'position' created by tho candidate- hr.ms'elf. Hie pointed out that the same attitude might he adopted 'afi a reluming officer-, died before an election, or did not conduct an election as he should have done. He thought it proper. in view of the public notice that had been taken of 1 the matter, to state the statute w’ais,. defective to deal with the -situation, and the returning officer had acted quite,sensibly and properly in the course which lie had i adopted.—P.A.
