TOBACCONISTS RECEIVE MONEY OFFENCE DENIED (Press Association). DUNEDIN April 11. A. prosecution of wide interest commenced in the Police Court this moroTiing, when V.' S. Jacobs, W. Stiglich, W. P. Elliott, and Walter 11. Maloney, tobacconists were charged each with receiving 6s from a constable for a ticket in Tattersall’s. There were similar charges againsr three assistants. The receiving of the money was admitted. The defence was that it was no offence to receive money for a ticket in a lottery outside New Zealand, assuming that-the prosecution succeeded in. proving it to be foreign lottery. T.t was also submitted that the?defendants were'merely buyers’ agents for transmission to,. Iltffiart, their part in the transaction not constituting a saleA *- Counsel pointed out that there was a decision in 1913 that the section did not refer to lotteries other s than in New Zealand. There lind been no appeal .from .that,, and Jacobs 1 all along believed that was the law a Decision was reserved.
