(U.P.A. by Elec. Tel. Copyright)

LONDON, Oct. 12.

The Privy Council dismissed the appeal of Gould and others v. the Commissioner of Stamp Duties, New Zealand.

The case, which came before the Full Court at Wellington last year, involved a question under the Stamp Duties Act. The appellants were George Gould, Herbert El worthy, ancl George Ranald McDonald as trustees of the estate of Ranald McDonald, who died at Christchurch on October. 21, 1928, leaving an estate the final balance of which was fixed for death duties at £337,317.

Broadly, the question involved was whether- a deed of settlement in the 'circumstances of the case, could oe treated as nugatory by the Commissioner of Stamp Duties. The Full Court affirmed the commissioner’s assessement, and the appeal .was dismissed. It (was from this decision of the Full Court that the appeal was made to the Privy Council.
