An interesting legal position arises in respect to the collection of. special rates bn properties over ■which. tne State Advances Department holdsmortgages, states the., Chronicle. 5 ' Mr. W. A£prrisqn, emurman of the Waiiotam County, at last iveek’s meeting, said that a test case wa s likely to determine tno matter. It appears that if special rat<?s on these properties are not-paid;; thev become a charge on th© council.'vet there is no machinery under which the council can- legally /paythem. On the other hand, the State Advances Department, acting within its rights as mortgagee, could claim, some or the council’s property—its; lorries, rollers, etc. When this information was given to ! the Waitotaru Conn tv, Councillors R- Farley and FH. Allen suggested that the Department should' be allowed to take the., lorries if they wanted to. “Let them: do; it,” said Councillor Allen; “Wo would hare them back in a week, A law like that is ridiculous.” /
