MEETING OF COUNCIL,

(Special To The Times).

An ordinary meeting of the Council was held on November ‘32; present : •Crs; A. E. Kemp (chairman), G. William soil, R. G. Saxhy, C. R.. E. Wood, C. W. Cowan, G. L. Fraser, 11/ T., Kohero, G. W. Stainton aficl G. EL Maddox. ] :: ; The Opotiki County Council conveyed an offer of aii annual contribution as from April last and during the currency, of the Palcira Road Loan of an amount equal to onefifth of a penny in the £ on the capital value of tlie .Mataugareka No. 3, To Kiinii No. 2 and Whangaparoa properties, conditionally that it collects the general fates on such properties and that other road access is not afforded the properties by it.— Resolved that the reply confers no. more than itn indefinite offer Of the indirect co-operation of, the Matan£areka, To, Kuftii and Whangaparaoa Stations in' the payment of the interest instalments on this Council’s loan expended in providing such stations only road accfess. and that such is not an appreciable Offer to this council’s, representations for a contribution towards the road’s maintenance costs, and that it be requested to submit a more reasonable offer without undue delay—-Suggestions regarding the including of the Te Ivunvi. Mataugareka and Whangaparaoa stations in this county were thereupon made and discussed iniormally. Mr. ,T. F. Wilson made representations for the fencing of the new road line taken through his property.. —Chairman deputed to deal with the matter. Mr. R. EL Tawliiri, further to lus complaint of the. impounding of his horses, advised that lie is furthering the matter with his solicitors and on-, closed for the council’s information notice from Messrs. Brown Bros, of the forbidding of the poundkeeper entering upon their property, and conveyed a request that the council permit him to graze his horses upon the old Onepoto Landing Reserve.— Poundkeeper to be advised. _ , The application of Pirihj Ka7‘apaina for a plyingTor-liiro license was subject to payment of tlie prescribed fee and fo the fulfilment of the usual conditions. Tenders received for tho supply of <559 clog collars ” for the yea r .1931 were dealt with as follows: Messrs. H. Is. Ganderston and Co., 51 each (accepted); Te Araroa Trading Co., Ltd., Sid; J. J. East, 9d; T. S, Bellamy, 6id ; F. G. Reid, Ltd., old. 'file clerk preseiiuql for execution o-rants in duplicate of the. tramway and quarrying rights, from the council to the Gisborne Quarrying Co. Ltd., and these were approved and executed. Or. Wood inquired as to what surfacemen were engaged on the metalling of Maddox’s Hill, and advised by the overseer that Surfacemen Evans and Wright were engaged on tlie work. , C’r. Maddox to tlie fencing obligation fo Mr. Neal, and asked” that the work' be proceeded wit' l as expeditiously as possible;—lt was decided that lack of funds made it impossible to undertake the work at present, and that it be undertaken immediately financial provision could bo made. Cr. Wood suggested that there was undue delay in transferring the leftover material from the Moluui road fencing to the site of Air. Neal’s fence, and recommended that the overseer be instructed to attend to the matter forthwith, whereupon tlie overseer was instructed accordingly. Cr. Afaddox asked if the progress of the Wharf road contract was satisfactory.—The chairman advised that no further work had been done .4Hue the last meeting, porisequ'er.t to a breakdown of the compressor, and expressed the opinion that the council might be obliged to take action towards determining the contract if it was not soon satisfactorily .proceeded with. Cm. Stainton inquired as to- the prospects of undertaking the expenditure of the Matakaoa Point road grant.—The chairman advised of his having arranged for Mr. Gardiner to have a renewed scheme submittetj for tho work as expeditiously as possible. Cr. Stainton advised ojt ATr. Hughes making representations for the fencing off of his old abandoned access way at the place where it ended on the’precipice made by the making of the Wharf road.—lt was suggested that AH. Hughes could quite easily overcome the difficulty and it was decided that the chairman investigate and arrange for tho requirements.

Or. Stainton advised of l-epresenta--tions made to him for the improving of Mr. YleGlutchicAs road so as to facilitate wool cartiiig.—The overseer was instructed to have tho requirements attended to. Or. Stainton advised of Apiata Apnniii alleging that a promise had been made him by the overseer that the Awatere river bank near YYhakapeka’s would bo protected by willows as a consideration for willows which he had supplied for the bridge site protection work, and complaining of the non-fulfilment of such promise.— The overseer advised that the' work could not be undertaken consequent to all the available money being expended for the bridge site work, and suggested that there was no immediate urgency Cr. Stainton drew attention to the need of repairs to the culvert near the Te Araroa Domain gate.—Overseer instructed .to a ttend to the matter. Cr. Kohere inquired of the chairman whether, ha had interviewed the District Engineer about the matter of the required route of the road around the bluff near tho East Cape, and was advised- by the chairman that the District Engineer had undertaken to investigate the matter. Cr. Fraser stressed the need of a drinking trough for Nara Pene’s horses. —To be provided without Undue delay. Cr. Ffasev. commented upon the unsatisfactory culverting of O’Regan’s road and advised of Mr. O’Regan’s continued requests to him lor improvements to the road.——Decided that Nara Pene bo placed fop a few days upon th<? work of effecting general repairs’ to tho road. Cr. Cowan referred to the council’s obligation to Ylr. McCullagli for componsation fo r ' land- -taken for .road purposes, and. to..the council’s undertaking of some time back to pay him £4O for-the strip of land severed in lieu of tho fencing of such land.— The matter, was discussed and the obligation' of the payment of £4O to Mr. YteCullagli acknowledged. _ Or. Fraser advised of .Mr. McCul- : lath’s “desire to a scer tain the area, of"the further land taken from, his property for the road near Clarke’s property, and to have' the council make an assessment of the compensation' for such.—The, cleric was directed to advise Mr. Yl’cCullagh of the area- and- of the council’s need to receive liis claim for the compensation for'the land. - . - : ’ , , Cr. Wood requested that the grader be placed on the. work of 'improving the Potaka-Waikura;. road between Oweku and Alohau for a few days.—Overseer instructed accordingly. . Cr. vSaxby advised of considerable damage caused the Pakira Hill , and other uiimetalled sections of the Pa-kira-Hick’s Bay road by the operating of motor lorries with chains on in the transporting of wool during the recent wet weather when the road was quite unfitted for such traffic. Continuing, Cr. Saxby commented upon the circumstances and suggested that action must forthwith be taken to prevent such damage being done.—The clerk reported _ that the persons named were operating motor lorries unlicensed for heavy traffic.— The matter of the damage to the road and the matter of the operating of unlicensed vehicles was discussed and the clerk was directed to instruct the Traffic Inspector to forthwith prosecute the persons mentioned for operating unlicensed motor lorries. Cr. Saxby advised of the need of either repairing or replacing Surfaceman Jamieson’s horse grader, and the overseer was instructed to inspect and arrange for repairing or teplacement.

Nominations were called for the vacancy on the Hospital Board, whereupon Cr. Saxby was duly nominated by Os. Wood and Cowan, and Cr. Maddox was duly .nominated by Crs. Stain ton and Kohere. A ballot resulted in the appointment of Cr. Maddox on the easting vote of the chairman.—Cr. Maddox expressed his fhanks for the office.

It was proposed by the chairman: “That the District Engineer be informed of the council finding itself very seriously affected financially in respect of the' Hick’s Bay wharf road contract now being carried out under Authority No. C 8546. consequent to its acceptance of the tender of £B6O Us for. such contract on the mistaken assumption that the amount of £573. £2 for £1 wqs being made available to it for such work when provision was made for £470 £2 for £1 only, and that a stressed request be made to him for the making of provision for the increasing forthwith of the insufficient authorisation, of £470 £2 for £1 to £573 £2 for £l, also that it be pointed out to the District Engineer that the' council, after calling tenders for tins urgent and essential work, three times was unable to obtain a 'tender within the estimate o r lower than the accepted one of £B6O 11s; and that it "was owing to a misunderstanding that the circumstances were not made known at the time of the acceptance of this tender.’’—Seconded by Cr.
