CASES BEFORE THE COURT.

(Special To The Times). ; ;; In the Magistrate’s Court at Tolaga Bay on November 5, a lengthy list of criminal and civil cases were heard before Mr. E. C. Levvey S.M. The Uawa County Council, proceeded against. Tonga Waru on')two charges for failing-to register dogs. 'The defendant was- ordered to pay legist-ration fees, court and solicitor’s costs. ‘ iVepa Rangi, charged with' using obscene language, pleaded guilty and was fined £3 and costs. J. Brooking admitted paternity ,of an illegitimate child. and was ordered to pay £6 expenses of birth, £3 3s solicitor’s cqsls and 12s 6d per week towards the support of the child. CIVIL ACTIONS.

CLAIM F 0« LOSS OF PIGS FAILS

John O’Connell (Mr. Portas) sued H</nvau Alahler Fleming (Mr. Wauchop) claiming £lO for a sow and litter of pigs alleged to have been destroyed by fire through the alleged carelessness of the defendant. Plaintiff stated that about the middle of September a fire was started on defendant’s property to burn off toi toi. Some of his sows were running among the toi toi on his property adjoining defendant’s. Later,, his brother found a, soav and litter of pigs burnt. Witness had looked round for other pigs but could not find any. The place where thp pigs were- burnt was near the boundary fence. -j • . Evidence was, given by plaintiff that he was travelling on the Tokomaru Road near , a bridge at Hikuwai at-about 25 miles per hour , when he noticed Te Rani about 2 chains away coming in the opposite direction travelling at about 40 miles an hour. He pulled up on the bridge, where Te Rani’s car crashed into him! Te Rani did not sound his horn. ha Rarina, a passenger in Gray’s Car, gave evidence that Te Rani said he could not apply his brakes. He did not hear any horn sounded. •f George Jones, roadman, Hikuwai, stated he was an eye witness and considered Gray was doing from 20 to 25 miles an' hour and stopped about three parts of the way over the bridge. Te Rani was doing: about 40 miles an hour when he came round the corner 2 chains from the bridge. J udgment was given for plaintiff for the amount claimed, with costs totalling £8 14s. On the application of Mr. Beaufoy stay of proceedings for the recovery of the claim was granted for 30 days.
