JUDGMENT SUMMONS CASES

The issue of an order in several judgment summons cases heard before Mr J. S. Barton, S.M., at the Magistrate’s Court yesterday, -was contested.

In the case Ralph Leeming (Mr. Blair) v. Thomas McGuire (Mr. Kinder), a claim for £2B 15s, the judgment debtor said lie had been in the employ of the Cook County Council, but had had no work since May, 1921, though if he could get work lie would be pleased to pay the amount. To Mr Blair, he said that liis wife owned some property in Te Kuiti, and witness himself had a half share in a fishing boat. “No proof of means,” commented the Magistrate.

Mr Burnard appeared for Theo. Pointon, judgment creditor in the case again Morgan Babbington, a claim for £37 13s 6d. Judgment debtor said lie was a laborer, but had once driven a car since May, 1921, though he had got nothing out of it. Pie had done no work in the last nine months, but received rents from native properties, the largest annual rental he received being £lO, though he got 13/4 and 7s per annum from each of two other properties. To Mr Burnard, witness said he bad not gone to the races this month, and had only been to the races twice since he had been m Gisborne. The case was adjourned for a fortnight, for judgment debtor to produce to the ! Gourt a statement as to his share in the native blocks in question. Sligo and Barclay (Mr Burnard) v. Cedric Stevenson, in which £l7 14s was the amount of the debt, was the judgment summons case next before the Court. In evidence, judgment debtor said the debt had been incurred in repairs to his mother’s car, which had been damaged in an accident. Pie could not get work at his old occupation of a drover, and had gone to. the freezing works since Xmas, earning there from £3 to £3 18s per week. He had been paying other bills. He was trying to sell his horse and dogs, which were worth about £4O, hut could not get a buyer for them. The Magistrate remarked that the debtor appeared to he endeavouring to clear himself, and no order was made.
