A RE-HEARING GRANTED"
[PRESS ASSOCIATION TELEGRAM. 3 WELLINGTON, March 9. The ease in which the “ New Zealand Times” Company claimed' from the Wellington Publishing Company (“The Dominion”) the sum of £3OOO for alleged libel in an article appearing in the latter paper on lltfb December, and in which the* jury- on Saturday disagreed, was again mentioned at the Supreme Court to-day. Mr C. P. Skerrett, K.C., appearing oil Ibehalf -of the plaintiff 1 company, moved, tinder section 154 of the Juries Act, for- a new trial to be held during the present session of the Court. The date of 'hearing, he suggested, could be fixed either by His Honor (Mr Justice Hosking) or the Registrar. His Honor replied that tlhe date had better ho fixed bv the Registrar. He (His Honor) was leaving for Gisborne on Thursday and ho did not know whether the Chief Justice would be available for the re-hearing. An order was made that- the re-trial be heard at a date to be fixed by the Regsitrar, His Honor remarking that he would give instructions to have « jury summoned for that date
