TVTOTICE is hereby given that the Gisborne Harbor Board, in con* junction with the Mayor, Councillors, and Burgesses of the Borough of Gisborne, intend to promote m the torth. coming session of Parliament a Rea. Bill- the objects of- which are as toll<T'That the lands mentioned in the first schedule of the said Bdl, winch are the properties of the Gisborne Borough Council, being parts of pubho roads abutting or contiguous to the Harbor Board 7 s foreshore, shall, without any conveyance or other _ assurance, vest in the Gisborne Harb r Board upon the same trust as other lands are hold by that body. . 2. That the lands mentioned m the second schedule of the said Bill which are the properties of the Gisborne Harbor Board, being parts of the Harbor Board’s foreshore, shall, without any conveyance or assurance, vest m the Mayor, Councillors, and Burgesses of the Borough of Gisborne upon the same trusts as other lands aie held by that body. _ „ ~ 3. That the Borough Council shall havo power to lease any part of the land mentioned in the second schedule to the Gisborne Fire Board, for such term and upon such conditions as the Borough Council and the Fire Board can agree. n 4. It shall be lawful for the Borough Council out of moneys raised by it as a loan for the purpose of building a bridge over the Waimata River from McLean Street to Hurahura Road, to build a bridge over that river from Ormond Road to Rutene Road, and the proportions of one-sixth to be paid by the Cook County Council and fivesixths by the' Borough Council, as ordered to be paid in respect of the first-mentioned .' bridge, shall be paid by those bodies for the last-mentioned bridge. 5. Any surplus moneys remaining out of the loan raised for the purpose of building the said bridge may be utilised in maintaining and repairing other bridges within the Borough of Gisborne. C. That the Borough Council shall have the use of so much land as may bo agreed upon between the Borough Council and the Gisborne Harbor Board, in writing, under their respective seals, as may be necessary for tiro construction and erection of if new bridge to span the Turanganui River connecting the terminus of Gladstone Road with the Wainui Read, oh the same site as the present bridge, or near thereto. 7. That the Borough Council shall have vested in it for road purposes an area of land a chain in width fronting the Gisborne Shoepfarmers’ Frozen Meat Company, Limited’s, Works at Kaiti, but any part of such area as extends on to wood-works or wjxarvrs shall ba repaired and maintained by the Gisborne Harbor Board. A copy of the Bill is deposited in the Magistrate’s Court at Gisborne, and is Open to public inspection for three complete weeks from the date hereof. The copy of the Bill is accompanied by plans of the lands proposed to be dealt with, certified to by an authorised surveyor. Dated this 14th day of May, 1913. AJOTICE is hereby given that the Gisborne Harbor Board intends to promote in the forthcoming session of Parliament a local Bill, the objects of which aro as follows: 1. To borrow the sum of £200.000 at 5 per cent, for such period as the Board thin'ks fit, with i per com. sinking fund. 2. Such sum of £200,000 to bo expended as follows: —with the unexpended balance and accumulated sinking fund of the loan of £200,000 bo. - rowed by the Board in the year 18S5, to discharge and pay off the debentures of the said loan when the same matures (this sum is estimated to be £75,000). To provide a sum of £17,000 for the extension or the present Breakwater contract. To provide a sum of £90,000 for new works p oposed bv the Board’s Engineer, and to provide a sum of £IB,OOO to pay off the Board's Bank overdraft. 3. Such sum to bo raised by issue of debentures secured upon rents, profits, and dues receivable by the B-ard as harbor and other dues, and a special rate upon the capital value of ail rateable lands in the Gi-buno Harbor District. 4. The Gisborne Harbor District is constituted by inclusion of Gi borne Borough and Counties of Cook and Waikonu. 5. The Bill provides that the Board’s right to continue to levy rates for payment of the interest and sinking fund on the existing loan shall not be prejudiced. ’ 6. The special rate shall not exceed one farthing (Jd) in the £ upon the capital values of all rateable property in the Harbor District.' 7. Before raising the loan a Poll is to be taken of all Ratepayers in the Harbor District, and if Poll is net carried by a majority of votes exercised. ioah is not to be proceeded with. 8. The Bill contains many provisions for taking such Poll in accordance with the provisions of “The Local Elections Act, 1908,” and provides that Ratepayers shall have one vote, and no more. 9. The amount of rate to be levied in each year is not to exceed such amount as is required to provide for payment of interest and sinking fund after taking into account the estimated balance of ordinary revenue available, deducting working expenses, cost of administration and interest accrued upon previous loan, and the Board to have power to direct the levy in each year of such part of the speical rate as shall be sufficient to provide such deficiency. 10. The Bill gives to debenture-hold-ers the right to insist upon the levy of the whole of the special rate if default bo made in payment of the interest or principal moneys secured by the debentures. 11. The Board to have all the powers of making, levying, or recovering rates in the Borough and Oount’os comiirising the Harbor District whi h any local bodv having rating powers within such Borough or Counties has or may have under the law for the time being in force regulating the making ancl recovery of rates therein respectively, and no rate or levy shall bo set aside or quashed by any proceedings in any Court or otherwise, and no defect in the same or making thereof shall bo set up as a defence to any action brought to recover the same. 12. Native lands within the distort shall be deemed rateable property if and so long as same aro occupied or used and profit is derived therefrom by Native owners, .whether from farming, rent, or royalty 13. The Board is to have the power, ponding raising of tlio loan, to borrow from its banker, or any other source, any sums, not to exceed the whole amount authorised by the liypothecation or mortgage of' debentures authorised to be issued, and all moneys so borrowed to be a first charge and ■ to be re-paid out of loan when raised. Interest not to exceed 6 per cent, per annum. 14. “The Gisborne Harbor Boar Enabling Act, 1907,” to be . repealed A copy of the Bill is deposited i: the Magistrate’s Court, at Gisborne and is open to public inspection fo three complete weeks from the 'dat hereof.
