A RUNAWAY TRAIN. LPREBB ASSOCIATION TELEGRAM.] GREYMOUTH, May 28. This morning, as the Public Works train was coming down the incline from the No. 2 State mine with fourteen tracks containing 120 tons of coal, the large 65-ton WE type of engine, recently p'aced on the _ line, failed to -hold the train, in spite of all the brakes being jammed on. Enginedriver Grey _ and Fireman Foi'd stuck to the train, until the engine the line with a dead end. They then jumped olear, and escaped without injury. The engine struck the bank and turned over, two trucks being damaged. The engine was (formerly on the Rimutaka. and requires a central rail, which is not yet in position.

At the Supreme Court to-day, before Mr Justice Williams, James Deo, aged 23, who was found guilty yesterday on £ charge of assault with intent te commit rape, came up fo. sentence.: His Honor said tho legislature prescribed' in the cas© of assault with intent to commit rape, where violence has been Used, that, in addition to hard labor, flogging may bo inflicted. “I am very reluctant to order floggings. At the same time when violence has been used, it is the intension of the Legislature that flogging should be inflicted. The sentence of Court is that you he sent'to prison for five years, and kept to hard labor, and in addition that you receive 12 strokes with the cat-o’-nine-tails.” THE BENEFIT OF THE DOUBT. A verdict of not guiltv was returned in the case against Kenneth McLeod, charged with carnal knowldego of a gir] under sixteen. Tho prosecutrix was a girl of fourteen of bad moral character, and prisoner’s defence was he had reasonable grounds to believe her to be over sixteen. At the Police Court to-day, before Mr Cruickshank, S.M., William Allison and William Kir wan were sentenced to one month for being found without lawful excuse on the premises of Lee Kirin, a Chinese cook shop.
