AUCKLAND, Saturday. 11l the Magistrate’s Court, Lhith Mary Thomas sued Heywood ami Co., C.'istchurch, for £3B, for loss «.I go ds in a trunk sent by defendantsagents to Auckland. Upon arrival in Auckland the trunk was apparently intact, and a receipt was given, “ Received in good order and condition." Upon opening the trunk, however, it was found that a number of fancy articles valued at £2B were missing. The principal facts were admitted, but defendants denied liability, alleging that they did not receive the trunk as common carriers, but as forwarding agents, and that plaintiff having requested the trunk to be kbpt till called for at the agency, the contract was complete when the goods were delivered there. Defendants’ only liability would be as warehousemen, when they were only liable if it was proved gross negligence had taken place Judgment was reserved. In reference to the Press Association telegram re teachers in South Africa, the secretary of. the Board lias wired to the Secretary for Education reminding him that the alleged irritation on the part of the Auckland Board does not exist. The Board expressed no opinion on the subject. While ready to co-operate with the Department in supplying teachers for the service of the Imperial Government, it is not eager to part with efficient teachers.
