CHANGE OF PREMISES NOT TILL AFTER JUNE 30 _ The holder of a wine and spirit license in Gisborne encountered an unforeseen obstacle when he made application recently for the right to transfer his business activities from one building to another. He was referred to his legal adviser, and the legal advice he received was to the effect that no provision existed for the transfer during the currency of the license. The licensee’s only course is to wait until the existing license, issued for the exercise of the trade of wine and spirit merchant from certain premises, runs out on June 30. He can then turn in his old license and apply for a new license, applicable to his new quarters. Pending the issue of the new license he must remain in his present premises, despite the fact that he has erected substantial new premises of his own. To stay on the old location until after June 30 will cost the merchant over £IOO.
The construction of the new building, with flats and shops for letting purposes as well as provision for the wine and spirit business on the ground floor was due to the expiry of a lease held on the other premises. Latterly the merchant has been on a month-to-month tenancy. The rentable portions of his new buiiding are fully occupied, and but for the fact that the law draughtsmen had not anticipated any licenseholder wishing to move into other premises. he would be settled in his new surroundings, and the old premises would be occupied by his successors there.
