APPEAL HEARING

E.C. COMMISSIONER NATIVE COURT JUDGMENT The hearing of an appeal by the East Coast Commissioner, Mr. J. S. Jessep, against a judgment of the Native Land Court given by Judge J. Harvey at Gisborne on November 7, 1045, was commenced by the Native Appellate Court this morning. The Chief Judge of the Native Land Court. Chief Judge D. G. Morrison, of Wellington, presided, and with him was Judge I. Pritchard, of Auckland. Judge Harvey in his judgment, which occupied 39 typed pages, directed the East Coast Commissioner to make certain amendments to his accounts for the period from July 1, 1037, to June 30. 1943. The grounds of the appeal were that the judgment was erroneous in fact, and ‘in law. and that it in part was not made in compliance with the provisions of Section 41 of the Native Purposes Act, 1931. Mr. H. P. O'Leary, K.C., of Wellington, and Mr. F. W, Nolan represented tlie appellant, while Mr. S. Carroll appeared for the respondents. Mr. J. S. Wauchop was present as the auditor appointed by the Native Land Court. In that capacity ho is an officer of the court. Mr O’Leary said he would also ask for Mr Bull Jo be called. There was no objection by counsel for the respondents. Chief Judge Morrison said the application to call additional evidence was an important question and the Bench would adjourn for a short time to consider it.
