TWO PARTIES TO ARBITRATION FAIL TO AGREE

WELLINGTON, This Day (P.A.). —“Seeing that you have both about completely extinguished each other, we will take an adjournment —you might be able to consider the position.” Mr Justice Tyndall made this comment in the Arbitration Court this morning after hearing the viewpoints of the New Zealand Fire Boards’ representatives and firemen’s advocates in the firemen’s industrial dispute. Mr W. J. Mountjoy, the fire boards advocate, challenged the right of Mr A. L. Monteith to appeal’ for the firemen’s union. He said that no warrant notifying the appointment as the union’s agent had been filed with tne Mr Mountj oy also challenged the right of Mr L. Glover to appear for the firemen. Two men could not appeal ■for the same party, said Mr Mountjoy, who quoted from union rules. His Honor held that the copies of the rules produced were not correct. “I want the rules of the union, not a phoney copy,” said his Honor. Adding that if technicalities were to be raised he was going to be certain of the accuracy of every detail. Mr Monteith, on behalf of the firemen, then challenged Mr Mountjoy s legal right to appear for the fire boards. . + His Honor, in adjourning the court, expressed the hope that the parties might be able to “come together on the technical points. When the court resumed a few minutes later, his Honor was informed that no agreement had been reached. He said that neither advocate had satisfied him that they were legally entitled to appear. His Honor announced that the coui t would be adjourned until this afternoon to enable the advocates to secure proof of their eligibility to appear.
