INJURY CAUSED BY NEGLIGENCE: CARRIERS’ LIABILITY
(P.A.) . WELLINGTON, October 14. Liability for injury to passengers is imposed on common carriers, irrespective of any conditions to the contrary, expressed or • implied, by the Carriers Bill, introduced in the House of Representatives today. The bill was read a second time pro forma and referred to the Statutes Revision Committee.
Private bills seeking to give effect to the principle contained in the bill have been introduced in recent years both in the House and in the Legislative Council, but were not proceeded with.
The Attorney-General (Mr H. G. R. Mason) said the bill dealt With two main points: the liability of common carriers who took a number of passengers for injury to the passengers arid the liability of carriers for negligence in the carriage of goods. He said a common carrier of passengers as the law stood could now exempt himself from liability for negligence in conditions on his ticket. The bill did away with that possibility and made the common carrier liable for negligence.
The law* relating to the liability for negligence in the carriage of goods had been rewritten in the bill, which bound the Crown.
