ENGLISH RULING ON .DESERTION

The Court of Appeal held by a majority that a wife's wilful and unjustifiable refusal to continue marital relations with her husband- did not entitle the. husband to divorce on the ground of'desertion. Lord Justice Tucker said it had been held that to constitute desertion there must be living apart. The mere refusal of a marriage’s obligations could not alone amount to desertion.
