PALMERSTON N.. Oct. 30. A case 'of considerable interest, to racing' circles opened in the Supi cine Court" to-day. The plaintiff was Stanley Edward Chatterton, a merchant, of Sydney. New South Wales, and the' defendant William Jonathan Crawford, a printer, o! Palmeiston Crawford advertised the thoroughbred. colt Rajputana for sale in the Sydney “Sun,” and Chatterton decided to buy at 1000 guineas, subject to a veterinary examination. Crawford forwarded a certificate which, accoiding to the statement ol claim, was worded as follows: “At the time of the examination I found the colt, in my opinion, sound.” In due course the colt arrived in Sydney, and Chatterton alleges that he discovered that the oft foreleg was deformed, and die animal otherwise varied from the advertised description, in that he had not a beautiful action, but on the contrary an ungainly, dangerous action, wmen greatly hampered his speed and .motive power. He was not an idea. Derby type, and never could have had an excellent racing career ahead oi him. , . . . .. The defence was a general demal ol the allegations, and that any warranty was at any time given. Chatterton seeks repudiation or the purchase, and a refund of his money, plus amounts expended for freight, feed, keep, etc., and interest at 5 per cent. The case is expected io last three days.
