Bright and Healthy: Aipinus is reported as being an improved hack, who should make his presence felt in for: booming engagements. Ho is a useful sort in heavy ground, and 'will mo.a likely be found saluting the judge in the near future.

Prospectc Bright: Expectancy is good in any ground, and her immed'aie prospects look very bright. She is engaged at. Te Haiti, and Ellerslie meetings, and she will have a large following the ne.xt time she is saddled up. Took No Harm:

Gipsy Moth, a half-brother to Puss Moth, who bolted at the Ohinemuri meeting last March, and collided with the railing dividing the course and saddling paddock, will make his reappearance at Te Rapa. He is stated lo have taken no harm from the mishap. and his next outing will be awaited with interest, for lie is stated to be a very smart maiden.

Doing Well: Greek Gold, who changed hands a few weeks ago, but still remains in the stable of F. Smith, at Takanini, is engaged in sprint events at Te Kuiti meeting. As he is a proved galloper in heavy ground, Greek Gold is likely to get some more money during the next few months.

Promising Hurdler: Tudor, who figures in the Te Kuiti Hurdles ,to be run at, Te Rapa next week, ran into fourth place on the fiat, at. Wanganui yesterday. He is a first-class jumper, with any amount of pace, and he should improve on his record over hurdles during the next few months. Verden Apt Pupil: The slippery nature of the course has held up the preparation of several jumpers at Riccarton, but yesterday morning, piloted by H. Turner, Verden went over six hurdles smartly. He has been a very ready pupil, and his progress, especially as he has been schooled alone, is remarkable. AVhen he takes his place among the hurdlers lie will soon prove the wisdom of his transfer from the flat.

JOCKEY’S LIBEL CLAIM. AUCKLAND, May 10. In the jockey’s (Samuel Henderson) libel action, the plaintiff, continuing his evidence, said that the “Referee” published a correction regretting that certain false statements were made, but it did not. give it much prominence. His Honor: But they say they offered to publish anything you cared to .say—they offered to throw their publication open to you to put the matter right. Why did you not take advantage of their offer? AWtness: I had had to much publicity. Dr. H. M. Goldstein, eye specialist, said that the plaintiff’s sight was affected after the accident, but later it improved. In witness’s opinion, plaintiff was capable of resuming his normal occupation as in 1932. Three horse trainers gave evidence that, after reading in the‘Re.fei - eo’ that

plaintiff had a silver plate in his head, they were not inclined to take the responsibility of employing him. Mr. Johnstone moved for a nonsuit on the grounds that the words of the article, in their ordinary sense, were not defamatory to the plaintiff cither personally, or in relationu to any trade, calling or occupation followed by him; that the innunendo set out in the statement, of ciaim was not a reasonable inference drawn from the words used, and, thirdly, that it. had not been proved that, at the time of publication of the alleged libel that plaintiff was following tire occupation of a jockey. After legal argument, His Honor reserved his decision on the non-sud. question until to-morrow. ACTION DISMISSED. f AUCKLAND. J'lay 11. I Mr. Justice Ostler, to-day. dismissed.j wit.li costs a.gai its: the plaint dt. ti’.o ac-t Gon. brought i:y Samuel Henderson.l against the printer and publisher cfl the Wellington Publishing Company, Ltd.

In his judgment on the non-suit motion, His Honor said that the words complained of in the article in the “Referee.” wore not capable of a defamatory meaning. The article must be read as a whole. To say of a man that he should not be allowed to follow his calling because that calling rendered him liable to severe fails, and that owing to a. former head injury such fall would be dangerous to him, was not defamatory, even if it was untrue. Such a statement might lie injurious to him, and cause him damage, hut it did not in (ho least affect bis reputation, or the esteem in which his fellow men regarded him.

Trotting MEETINGS TO COME. Mav 12. —Oainaru. May 12, 14.—Waikato. June 2, 4. —Canterbury Park. Juno 2, 4. —Hawke’s Bay. June 9.—Ashburton. June 12. —Waikato. June 14.—Rotorua. June 20, 23. —Auckland. Returning Home: Space has been booked on the Wanganella, which leaves Auckland on May 25, for Sydney, for Walla Walla and Auburn Lad.

Good Class: Dundee has been very impressive in all his races, but his effort at Forbury on Wednesday removed any doubts regarding his ability to go fast. The Nelson Derby four-year-old has not done a great deal of racing, and looks certain to reach good company with more time and experience. To Attempt Record:

Given suitable track conditions. Impromptu will attempt a track record at the Waikato Trotting Club’s meeting to-morrow. Claudelands has one of the best grass, tracks in New Zealand, and Impromptu’s recent form would suggest that he will run a merry mile.

Consistent But Unlucky: Ayrmont Chimes has been racing consistently since he has been back in the fold, and another second and third went, to his list of minor placings at Forbury yesterday. He appears to fall just short of first-class.

Her Turn Will Come: The form shown by Tryment at Cambridge was most, consistent. .In her first start, she run third in the Hautapu Handicap, and later was second to Ringtrue in the Bruntwood Handicap. This mare is a reliable pacer, and with a Ijttle improvement should get on the winning list again shortly. A Likely improver: Nelson Lu van paced a solid race in the Introductory Handicap at Cambridge. He began well and was always in a. handy position, being third at the home turn. He finished on well, and although he knocked 7s off his handicap he found Allworthy just too good for him. The latter showed nearly 9s improvement, so Nelson Luvan was set a good task. This maiden is a reliable pacer and a bright future looks assured for him. A Promising Pacer:

Ringtrue won his first race at the recent Auckland meeting, and he followed up this success by annexing the Bruntwood Handicap at. Cambridge, going 7 2-5 s better than he was handicapped to do. He went away smartly and led throughout, giving a fine display of pacing. Ringtrue has two engagements at. the Waikato meeting on” Saturday, and now that he Ims struck form he should be very hard to beat in whichever he is started.

Showed Plenty of Speed: Kewpie’s Bond ran two fair races at. the recent meetings at Epsom, finishing close up fifth on each occasion. Her next appearance was in the opening event at Cambridge. in which she made most of the running, but tired over the last, half furlong, eventually finishing third. She is a four-year-old half-sister to Kewpie’s Triumph, and Kewpie’s King. and with more experience is likely to do much better. Kewpie’s Bond is engaged at the Waikato meeting on Saturday.

Finished on Well: Ando Patch showed plenty of puc 1 when lie led the field for a good portion of the way in the Whangarei ’Handicap at the Northland meeting at Epsom last week,, and in conseqmmco he was thought, to have a good chance in, the Leamington Hendicap nt Cambridge on Saturday. Ho did not go away too well and was about, the centre of the field till the straight. However, he finished on to get. fourth, and if he had gone away properly he would have boon very troublesome. Ho is due to make his next appearance in a similar' event at the Waikato meeting on Saturday. Has Good Prospects: Rose Marble showed promise in the Whangarei Handicap at Epsom recently, being well, up for a good portion of the way. In the Leamington Handicap at Cambridge she began

quickly and was racing second to Te Kahn when the field had settled down, a position she held to the finish. She challenged Te Kahu about two furlongs from home, and though she got up to him he drew away again and heat her comfortably. This mare is on the improve, and as she appears* to handle soft going to advantage better results can be expected .of her.

An Easy Win: Allworthy was taken north for the recent combined meeting at Epsom, but failed to get into the money in his two starts in both of which he was well supported-. On Saturday he contested the Introductory Handicap at Cambridge, and, giving 24yds to the rest of the field, he began very quickly and was racing in fourth position with half the journey gone. Kewpie’s Bond was the only one in front of him nt the home turn, but he quickly settled her, and won comfortably by a couple of lengths. He is trained by L. O. Thomas at Hutt, and is a. fine type of pacer, who is likely to do much better later on. OAMARU MEETING. MATCH RACE ATTRACTION. Horses that raced at Forbury Park, figure strongly in the Oamaru Trotting Club’s list of acceptors for tomorrow. The attraction will be the Invitation match race, between four of the pacing champions of Australia and New Zealand. Fine weather conditions are all that is required, and the meeting will most likely prove the best yet held at Oamaru.
