OWNERS’ WRIT FOR INJUNCTION. 1 A writ seeking a Supreme Court injunction to restrain the New Zealand Trotting Conference from reim- j posing the disqualification on the j horse Ngingongingo and the driver, A. i Bryce, has been issued on behalf of £ Mr R. M. Morten, owner of the horse. 1 The writ asks:— '1

(1) That the reimposition by the Trotting Conference appeal judges of the disqualification of Ngingongingo may be set aside and declared void. (2) That the defendants be restrained from maintaining, enforcing, or in any* way giving effect to the judgment reimposing disqualification. (3) That the defendants be ordered to pay out costs arising out of the case against H. F. Nicoll, John Rowe, H. R. McKenzie and B. S. Irwin, As a result of the Trotting Conference’s reversal of the decision of the board of the New Zealand Trotting Association to lift the disqualification imposed by the Auckland Trotting Club, the members of the association resigned in a body. At a subsequent meeting of the board of the association, however, the following motion was carried: — “Having arrived at an understanding with the president of the New Zealand Trotting Conference that was'

mutually satisfactory, au amendment be made to Rule 336 and the resignations of members of the association be deferred.”

Rule 336 refers to the powers of stewards in regard to inconsistent running. It was under this rule that the Judicial Committee of the Auckland Trotting Club disqualified' Ngingongingo after he won the Labour Day Handicap. The members of the board of the Trotting Association, with the exception of Mr T. W. J. Buxton, Auckland, resigned when an appeal by the club against the removal of the dis- ■ qualification by the association was : upheld. OAKLEIGh” PLATE MELBOURNE, February 12.
