DISEASED MAN REFUSED BAIL. (Special to "Star.”) AUCKLAND, September 10. Wedding bells will not ring for Gerald Rutherford and his prospective wife, at least not until he is allowed his freedom. ‘ . Yesterday, Rutherford was remanded in custody on a charge of obtaining the sum of £5 15/ by falsely representing that he was J. Armstrong, of Remuera Road, and that he had' been appointed‘■'organist at the De Luxe Theatre, Wellington. Application for bail was made by an Anglican minister, who said that Rutherford was to be married in a day or so. Chief Detective Cummings opposed the granting of bail, stating that accused was suffering from a certain complaint. However, the Magistrate adjourned the matter until this morning. so that a report from the examining medical officer at the gaol , could be obtained. Chief Detective Cummings to-day, at the Police Court, handed the report to the Magistrate, stating that the doctor had confirmed what he had stated yesterday. “It would be cruelty to the girl to allow accused to marry her,” said .Mr Hunt, S.M. “In the girl’s own interest she should not be married to him. No. I refuse to grant bail.’.’ Mr Dickson, who appeared fpr Rutherford, agreed with Mr Hunt, stating that it would be in the accused’s interests also if the marriage were prevented.
