CASE of three-farthings DAMAGES (Per Press Association) Wellington. Sept. 27 When the Court of Appeal ease, Buddie v. Sievwriglit, was resumed, Mr. Weston, counsel for appellant, submitted that appellant should he allowed to appear as a pauper, not only lieeuu.se his liabilities greatly exceeded his assets, but also because he lia 1 no income and lived in a smte of absolute destitution. Mr. O’Leary, counsel for respondent, submitted that the trial Judge was cor»ect in both as to the linding of justification and the assessment of damages, and that no reasonable ground for appeal existed. After considering the question the Court held that there were reasonable ground for appeal and that appellant was a pa paper. Leave to appeal in forma paux>eris was accordingly granted.
