Th High Court has delivered a decision importantly affecting co-opera-tive companies as regards restraint of trade. Tlie Court, in upsetting the Lower Court’s decisions, held thatwhere co-operative competition binds : ts members to supply all their produce to tlie company.for a long period, file rule is invalid and in restraint of trade unless a member can cease to become a member wherever he leases. In this case under appeal, defendant’s share was not fully paid no atul he could not get out when lie nleased. The decision is the first of the kind given in Australia liy tlie High Court.
