RESTITUTION OP CONJUGAL

RIGHTS

Lucy Pybus v. John Pybus.—Application for restitution of conjugal rights. Mr Lyon appeared for the petitioner.

Lucy Pybus, residing at Crofton, the wife of John Pybus, storekeeper, of Rata, stated that she was marreid at Halcombe, in the house of Mr Harris, schoolmaster, in 1881. She and her husband remained in Halcombe till 1892, when they removed to Rata, where they lived for 13 years. In 1899 Mr Pybus. went to Adelaide to see a brother who was dying, and on his return (for reasons which witness now knew) he became dissatisfied with witness. Friction occurred between them, and in 1904, Mr Pybus left home, and had since refused to return. Witness was now living in Crofton.

A decree for the restitution of con jugal rights was then granted.

SENTENCES,

Robert John Foster was brought up for sentence, on the charges of which he had been found guilty, of falsifying the books of the Mangaweka Sash and Door Company, and embezzlement of monies from the Company.

Mr Mackay, who appeared for the accused, asked for probation. His Honor admitted the accused to two 'years' probation, special conditions being imposed. He was ordered to pay £27 5s costs towards the prosecution, the amount to be paid in fdur equal half-yearly instalments, commencing on the 31st of December next.

John Fisher, found gifilty of obtaining goods by false pretenses, and for the theft ,of money was then brought forward for sentence. Mr Mackay made an application for probation. His Honor admitted him to prefba tjon for two years, with special conditions. He was ordered to pay £9 18s 6d to the Post Office for the lad from whom he stole it. the money to be paid in one month from date; also pay the costs of the action, £23 18s 9d, within three months,- and the sum of £30 for the goods obtained under false pretences, within six months. -
