The question whether the safety of a passenger's luggage which was being transported by launch from one uart of Marlborough Sounds to another was the responsibility of the launch driver or the passenger was decided in a reserved decision by Mr Maunsell, S.M. The decision followed an action to recover the value of a suitcase lost overboard from a launch plying between St. Omer and the Portage. The magistrate held, that having undertaken to carry both the passenger and his luggage, the launch driver must be regarded as having control of the luggage and, therefore, was responsible for it when it was lost. The plaintiff was awarded the full amount of the claim, which amounted to £l2. The defendant intends to appeal.
