PUBLIC NOTICES. DUNEDIN CITY COUNCIL. . NOTICE OF CONFIRMATION OF " SPECIAL ORDER AUTHORISING THE RAISING OF A REPAYMENT LOAN OF £84,400. ~ JSUBLIC NOTICE IS HEREBY GIVEN Jl that the Dunedin City Council,, at a Special Meeting convened tor the purpose, and held on Monday, April 23, 1345, passed the following resolution, viz.:— THAT WHEREAS under the authority of Clause 16 of the "'Dunedin City Loans Conversion Order, 1934," it' is provided that in certain of the securities issued pursuant to such Order for the redemption thereof at the option of the Dunedin City Council on such date prior to thai specified in the said securities as the said Council might fix by' notice in that behalf published in the ' Gazette ' at least three months before such prior date: AND WHEREAS the Council .has in exercise of the said option duly given notice in the ' Gazette ' of its intention, to redeem on the First (Ist) day of April, 1945, certain of such securities amounting in the aggregate to 1 of Eigiitv-four Thousand Fcuv L... .. rounds '(£84,400), the dale of the redemption of which is specified in such securities as the First (Ist) day of April, 1948; AND WHEREAS the Council- in order to give effect to such intention has determined to raise a loan of Eightyfour Thousand Four Hundred Pounds (£84,400), on terms . sanctioned by the Local Government Loans Board, the said Dunedin City Council, now therefore •hereby resolves as follows, so that this resolution may be confirmed at a subsequent meeting of the Council and operate as a Special Order, viz.: — 1. THAT, in pursuance and exercise of the powers vested in it in that behalf by the " Local Bodies Loans Act, 1926," and every other power in that behalf enabling-it, a Special Loan of Eighty-four Thousand Four Hundred Pounds (£84,000) be raised on the terms hereinafter provided, viz. : Z. THAT the said proposed loan be known as the." Dunedin City Conversion Loan Fourth Repayment Loan, 1945," and shall be raised for the purpose of repaying portion of the City of Dunedin Conversion Loan, 1934, as hereinbefore set forth. 3. THAT the security for the payment of the interest and other charges , on the said loan shall be a special annually recurring rate of One Halfpenny (Jd) in the Pound (£) -upon the rateable value, on the basis of the annual value, of all rateable property of the City of Dunedin, comprising the whole of the said city. 4. THAT the term of the said proposed loan shall be Three years from the First (Ist) day of April, 1945. 5. THAT, with respect to the provision for repayment of the said Joan of Eighty-four Thousand Four Hundred Pounds (£84,400), the proviso to subSection. 3 of Section 32 of "The Finance Act, 1938" (as set out in sub-Section 2 of Section 29 of " The Finance Act, 1941.") shall apply, and accordinglv the provisions . of subClause 2 of Clause 20 of the Dunedin City Loans Conversion. Order. , 1934, ■ shall be construed as if the de-" benturcs amounting to Eighty-four Thousand Four Hundred Pounds (£84.400) redeemed on the Ist day of April, 1945. had not been'. redeemed as at that date but had been redeemed on the first .day of April, 1948. 6. THAT the said Soecial Loan of Eightyfour Thousand Four Hundred Pounds (£84,400) be raised bv the issue of debentures under "The Local Bodies Loans Act, 1926," and bear interest at a rate not exceeding Three Pounds Five Shillings (£3 ss) per centum per annum. Such interest .shall be payaWe half-yearly during the currency of the loan, being a period of Three years, or until the loan is fully naid off. and that rounons be annexed to pi.cli such debenture accordingly. The said debentures and counons shall be payable at any branch of the Bank of "New .Zealand, within New Zealand, free of exchange to the'holder thereof. 7. THAT the Corporate Seal be affixed to all such debentures, and that all such debenture' and coupons be signed by the Mayor and countersigned by the City Treasurer, provided that., with respect to '• the , couoons, the signatures thereon shall be lithographed.
