ILLEGAL POOLING ALLEGED CRIMINAL PROCEEDINGS PENDING Tress Association—By Telegraph—Copyright WASHINGTON, December 26. It has been announced that criminal proceedings under the Sherman Antitrust Act are to bo issued against the American Society of Composers, authors, and publishers, Broadcast Music Incorporated, the National Broadcasting Corporation, and the Columbia Broadcasting System. The charges are based on “ illegal ” pooling of very desirable copyright music for the radio to eliminate competition and create a monopoly, “ illegal price fixing,” which restrains a composer's right to bargain, and mutual boycotts by the American Society of Composers, Authors, and Publishers, and, the broadcasting chains (through .Broadcast Music Incorporated) in an attempt to monopolise the supply of m usic.
